THE KIERSTED / SYSTEMS 2010 LEGALTECH® NEW YORK SMART CAR DRAWING.
- Eligibility. The “Kiersted / Systems 2010 LegalTech® New York Smart Car Drawing” (“Drawing”) is open to legal residents of the United States who are licensed drivers and over the age of eighteen (18) on February 3, 2010. By entering the Drawing, participants agree to abide by the terms and conditions of these official rules (“Official Rules”). The following persons are excluded from participation in this Drawing: employees and immediate family members of Kiersted Systems, LP (“Sponsor”) and its subsidiaries, affiliates, officers, directors, assigns, advertising, promotional and fulfillment agents, attorneys, accountants, and other representatives and the persons with whom each of the above are domiciled. DRAWING IS SUBJECT TO ALL FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS. Void where prohibited.

How to Enter. Promotion begins February 1, 2010 and ends February 3, 2010.
- Online Entry: To enter access the official entry form located at www.kiersted.com/smartcar and supply all required information.
- In Person Entry: Visit the Kiersted / Systems booth at the 2010 LegalTech® New York Event and register your conference badge or complete the entry form. All entries become the property of Sponsor and will not be returned.
- Drawing. The prize consists of one 2010 Smart Car automobile or a donation to the Red Cross, American Heart Association or the United Way (“Charity”) or cash equivalent as selected by Winner in an amount equal to the approximate retail value. Total approximate retail value of the prize: $15,000.00. It is solely the entrant's responsibility to ensure that he/she fully complies with these Official Rules and the awarding of the prize is contingent upon full compliance with the Official Rules. The Drawing ends on February 3, 2010. Only one entry per person regardless of the method of entry. One winner (“Winner”) will be selected by a random drawing from the correctly completed forms submitted via online entry or in person entry on February 15, 2010 at Sponsor’s offices and will be announced immediately upon selection. Odds of winning depend upon the number of eligible entries obtained. Sponsor Reserves the right to terminate or suspend the Drawing without notice, at any time and for any reason. Sponsor also reserves the right to alter or amend these rules at any time; PROVIDED, however, the prize will be awarded under all circumstances.
- Prizes and Approximate Retail Values. Winner may select the option of (i) one (1) 2010 Smart Car automobile, or (ii) a donation to the Charity of Winner’s choice or (iii) the cash equivalent for the approximate retail value of the Smart Car. Prize is not transferable, and no substitution of a prize is permitted in whole or in part except at the sole discretion of Sponsor. All taxes, fees, and surcharges on prize are the sole responsibility of Winner. Winner must comply with all of the terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. Winner will be issued an IRS 1099 Form for the fair market value of the prize inclusive of sales or other transaction taxes. Title, applicable taxes, registration, license, and similar fees, and insurance and costs of operating vehicle are Winner's sole responsibility. The vehicle will be delivered with standard equipment for its make and model; any available upgrades and options are at the sole cost of Winner. Winner must show proof of valid driver's license and valid insurance prior to taking delivery of the vehicle. Winner must accept prize and complete all necessary forms at a car dealership selected by Sponsor. Should Winner fail to take delivery of the vehicle within 30 days following notice of availability, or should Winner refuse the prize, or in the event of noncompliance with these Official Rules, the prize will be forfeited. Upon prize forfeiture, no compensation will be given. Sponsor makes no warranties with regard to the prize.

- General. By participating in this Drawing, participants agree to be bound by these Official Rules and the decisions or interpretation of the Sponsor regarding the Official Rules which shall be final in all respects. All federal, state, and local taxes, insurance, licensing, registration, delivery, shipment and title fees are the sole responsibility of Winner. By registering for the Drawing or accepting a prize participants release and hold harmless Sponsor and its subsidiaries, representatives, sponsors, affiliates, directors, officers, employees, consultants and assigns, against any and all claims, liability, loss, injury, or damage of any kind (including, without limitation attorneys’ fees and expenses of litigation) arising from participation or its acceptance and use of any prizes. Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use or redemption of any prize. Winning a prize is contingent upon fulfilling all requirements set forth herein. If Winner chooses not to accept the prize, or is ineligible to accept the prize for any reason, another Winner will be chosen at random by Sponsor. Participants represent and warrant that all information provided to Sponsor in connection with the Drawing will be, and is at the time provided, true, correct and complete.
- Disclosure of Winner. For a disclosure of the Winner, available after February 16, 2010, send a self-addressed, stamped envelope to Kiersted Systems, LP, 1301 Fannin St., Suite 750, Houston, TX 77002-7020.
- Release. By registering for the Drawing, participants agree to the use of their name, address (city and state only) and/or photograph, videotape or any likeness for advertising or publicity purposes, and to the use of statements made by or attributed to participant relating to Sponsor, and any and all rights to said use, without further compensation.
- Permission to Contact. By registering for the Drawing, participants consent to contact by the Sponsor and Sponsor’s affiliates for the solicitation of services provided by Sponsor.
- Limitation of Liability. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with the Drawing or by any technical or human error that may occur in the processing of entries in the Drawing. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or authorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of email on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in this Drawing. If, for any reason, the Drawing is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, hacking, or any other causes beyond the control of Sponsor which corrupt the administration, security, fairness, integrity or proper conduct of the Drawing, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Drawing. Sponsor is not responsible for late, lost, illegible, incomplete, stolen, misdirected or postage due entries. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW (INCLUDING ALL ATTORNEYS’ FEES, COURT COSTS AND EXPENSES).
